Cain Velasquez trial set: UFC postpones ‘one last time’ as child care license subpoena issue resolved

Trial date has not yet been set for Cain Velasquez, who faces charges including attempted murder. However, after months of delays and continuations, Velasquez appeared for two hearings in Santa Clara County (California) court on Wednesday.

He is scheduled to return to court on March 6 and April 17 for proceedings on the subpoena motion. Additionally, a “final” trial setting hearing is scheduled for April 24, when a trial date will be officially determined.

The first hearing revolved around two subpoena motions by Velasquez and defense attorney Renee Hessling. The UFC was ordered to submit documents by March 1 and an additional hearing on March 6 was set.

The second subpoena was directed to Community Care Licensing (CCL), the agency responsible for licensing child care centers in California, to obtain documents from Patty’s Daycare LLC, where Velasquez’s 4-year-old son was allegedly sexually abused.

During the hearing, attorney Stephen DeFilippis moved to quash the subpoena request, but the judge continued the CCL’s summons issue to April 17.

Despite concerns from the district attorney about safety, the judge decided to proceed with the court proceedings. Both parties showed willingness to consider advanced case management toward resolution.

Velasquez, 40, has pleaded not guilty to multiple charges, including attempted murder, after he allegedly chased and opened fire on a car containing three people in February 2022. He spent over eight months in prison before being granted bail in November 2022.

Gularte, the accused of “lewd acts” with Velasquez’s son, is awaiting trial, and a hearing on Motion 995 is scheduled for March 11th.
